    1. Who We Are

    ADK By Owner, LLC (“ADK By Owner,” “we,” “us,” or “our“) operates adkbyowner.com and its related subdomains (collectively, the “Site“). We are an advertising platform that allows property owners in the Adirondack region to list real estate, vacation rentals, and long-term rentals for sale or rent directly to the public, without using a real estate broker or agent. We are not a real estate broker, and we do not represent buyers, sellers, owners, or renters.

    This Privacy Policy explains what information we collect through the Site, how we use it, who we share it with, and the choices available to you.

    2. Scope

    This Policy applies to everyone who uses the Site, including:

    • Visitors browsing real estate listings, vacation rentals, or long-term rentals
    • Owners/Listers who create an account to list a property and pay a listing fee
    • Buyers and Renters who submit an inquiry about a listed property, or leave a review of a vacation rental
    • Subscribers who sign up for New Property Alerts or other mailing lists

    It does not apply to the practices of property owners once you contact them directly (see Section 6), or to third-party sites we link to (see Section 10).

    3. Information We Collect

    a. Information You Provide to Us

    When What we collect
    Creating an Owner account / listing a property Name, email, phone number, mailing address, property address and details, property photos, username and password
    Paying a listing fee Billing name and address, and payment details processed by our payment processor (see Section 5 — we do not store full card numbers ourselves)
    Submitting a buyer/renter inquiry on a listing Your name, email, phone number, and the content of your message (which is forwarded to the property owner)
    Submitting a vacation rental review Your name (or display name), review content, and rating
    Signing up for New Property Alerts or other mailing lists Email address and any search preferences you provide (e.g., region, property type, price range)
    Contacting us directly (Contact Us form, email, or complaint submission) Name, email, phone number, and the content of your message, including complaint details about a listing
    Managing a vacation rental listing calendar Availability/booking calendar data you enter as the property owner

    b. Information Collected Automatically

    When you browse the Site, we and our service providers may automatically collect:

    • IP address, browser type, device type, and operating system
    • Pages visited, search terms used (e.g., town/location, property type, price range), and time spent on the Site
    • Referring website and general location inferred from IP address
    • Cookies and similar tracking technologies (see Section 4)

    We currently use tools such as the following to collect this information: Google Analytics.

    c. Information From Other Sources

    If you interact with us through Facebook or YouTube, those platforms may share limited information with us (such as that you followed or messaged us), subject to their own privacy policies.

    4. Cookies and Tracking Technologies

    We use cookies and similar technologies to:

    • Keep you logged in to your Owner account
    • Remember search preferences (e.g., last-searched region or property type)
    • Understand how visitors use the Site so we can improve it
    • Support advertising/remarketing

    You can control cookies through your browser settings. Blocking cookies may prevent some features of the Site — such as staying logged in to your Owner account — from working properly.

    5. How We Use Your Information

    We use the information we collect to:

    • Create and manage Owner accounts and property listings
    • Process listing fee payments and send billing communications
    • Deliver buyer/renter inquiries to the relevant property owner
    • Publish reviews on vacation rental listings
    • Send New Property Alerts and other communications you’ve signed up for
    • Investigate and respond to complaints about listings
    • Operate, maintain, secure, and improve the Site
    • Comply with legal obligations and enforce our terms

    We do not sell your personal information to third parties for their own marketing purposes.

    6. How Information Is Shared

    With property owners. If you submit an inquiry about a listing, your name, contact information, and message are sent directly to the property owner so they can respond to you. Once you contact an owner, any further communication happens directly between you and that owner, outside of the Site — this Privacy Policy does not apply to what the owner does with your information after that point.

    With service providers. We share information with third parties who help us operate the Site, such as:

    • Cloud hosting and infrastructure providers
    • Payment processors for listing fee transactions
    • Email delivery services for account, billing, and marketing emails
    • Analytics providers (see Section 3b)

    These providers are only permitted to use your information to perform services on our behalf.

    For legal reasons. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, property, or safety of ADK By Owner, our users, or the public.

    Business transfers. If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change via the Site.

    7. Data Retention

    We retain Owner account and listing information for as long as the account is active, and for a reasonable period afterward to comply with legal, accounting, or dispute-resolution needs. Buyer/renter inquiry content is retained long enough to fulfill its purpose (delivering your message to the owner) and for a limited period afterward for support and complaint-handling purposes. Mailing list information is retained until you unsubscribe.

    8. Data Security

    We use reasonable administrative and technical safeguards designed to protect your information, including encrypted connections (HTTPS) and access controls on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

    9. Your Choices and Rights

    • Marketing emails: You can unsubscribe from New Property Alerts or other marketing emails at any time using the unsubscribe link in those emails.
    • Account information: You can review and update your Owner account information by logging in to the Owner Administration Page.
    • Cookies: See Section 4.
    • Account deletion: To request deletion of your Owner account or associated personal information, contact us at [email protected], subject to our need to retain certain records (e.g., for billing or legal compliance).

    10. Third-Party Links

    The Site contains links to individual property listings, owner-provided contact details, our social media pages, and other third-party sites. We are not responsible for the privacy practices of these third parties, and we encourage you to review their privacy policies before providing them with information.

    11. Children’s Privacy

    The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it.

    12. Changes to This Policy

    We may update this Privacy Policy from time to time. We will post the revised policy on this page with an updated “Last Updated” date. Material changes will be communicated via the Site or by email where appropriate.
